Conflict of Interest Charge Clouds Prospects for Judicial Nominee With Penchant For Anti-Environmental Junkets

Documents indicate that one of President Bush’s nominees for the U.S. Court of Appeals, Third Circuit (which covers Pennsylvania, New Jersey, and Delaware) had financial interests that he failed to disclose, yet issued numerous rulings in a major financial fraud case.

Doug Kendall, Founder and Executive Director of the Community Rights Counsel, prepared this analysis of the case and Judge Smith’s role in it.

Why do we care?

For the last four years, Environmental Working Group (EWG) and the Community Rights Counsel have teamed to stir action in judicial ethics reform, raise awareness of judicial junkets, and to ban these anti-environmental “seminars” outright.

Moreover, Judge D. Brooks Smith has consistently ranked near the top of the list of the most heavily "junketed" judges. This document details these activities.
